1. Introduction

1.1 These terms and conditions tell you the rules for using our Site.
1.2 By using our Site, you confirm that you accept these Web Conditions and that you agree to comply with them. If you do not accept these Web Conditions in full, then you must leave this Site immediately. We recommend that you print a copy of these terms for future reference.
1.3 You are also responsible for ensuring that all persons who access our Site through your internet connection are aware of these Web Conditions and any other applicable terms of service, and that they comply with them.

2. Who we are and how to contact us

2.1 The following website: www.actorstrust.org.uk is a site (“Site”) operated by The Actors’ Benevolent Fund) (“We”, “Us” or “Our”). We are registered in England and Wales under company number 00243374 and charity registration number 206524 and have our registered office at 6, Adam Street, London., WC2N 6AD.

3. Use of these Web Conditions

3.1 These general terms and conditions (‘Web Conditions’) set out Your rights and obligations, and those of Actors’ Trust in relation to this Site and its Content.
3.2 These Website Terms refer to the following additional terms, which also apply to your use of our Site:
3.2.1 Our Privacy Policy, which explains how we collect, use and store your personal data; and
3.2.2 Our Cookie Policy, which sets out information about the cookies on our Site.
3.3 If you apply to become a member of the Actors’ Trust our Membership Code of Conduct will apply to your membership.
3.4 Any additional terms that apply to You, will be given to You separately and may be amended from time to time (see clause 4 below).
3.5 You agree to these Website Conditions every time You access any part of the Site or make use of any of the Content.

 

4. Definitions

4.1 Unless otherwise defined, any capitalised words in these Website Terms have the meanings given below:
‘Business User’ means an actor, actress or any other person using this Site for the purposes of their trade, business, craft or profession.
‘Content’ includes, but is not limited to, all information, text, graphics and images that appear on the Site, including any Third-Party Content, and the design, look and feel of the Site itself.
‘Consumer User’ means any individual that is using this Site for purposes wholly or mainly outside of their trade, business, craft or profession.
‘Intellectual Property Rights’ means any:
(a) rights in inventions, patents, registered designs, design rights, know-how, trademarks and service marks (whether registered or not);
(b) any trade, brand or business names and any distinctive sounds used to differentiate the goods and services of a business;
(c) utility models;
(d) copyright (including all such rights in computer software and databases);
(e) moral rights;
(f) any rights or forms of protection of a similar nature to any of the above and having equivalent or similar effects to any of them, and
(g) all or any other intellectual or industrial property rights whether or not registered or capable or registration,
in each case whether subsisting now or in the future in any part of the world and including all applications and rights to apply for any of such rights together with all or any goodwill relating to such rights.
4.1.2 ‘Third Party Content’ means the material on the Site or accessed through the Site that is controlled or owned by third parties and licensed to the Actors’ Trust.
4.1.3 ‘You’ and ‘Your’ means the person entering or accessing the Site as the case may be.

 

5. Changes to these Web Conditions and to Additional Terms and Conditions

We may change these Web Conditions at any time. Every time you wish to use our Site, please check these Website Conditions to ensure you understand the terms that apply at that time. These Website Conditions were most recently updated on 11/09/2025.

 

6. We may suspend or withdraw our Site

6.1 We try to keep this Site website available 24 hours a day, however, we do not guarantee that our Site, or any content on it, will always be available or be uninterrupted and we will not be liable if for any reason this Site website is unavailable at any time or for any period.
6.2 We may suspend or withdraw or restrict the availability of all or any part of our Site for business and operational reasons. We will try to give you reasonable notice of any suspension or withdrawal.

 

7. Intellectual Property

7.1 The name “Actors’ Trust” and the Actors’ Trust logo (“Marks”) are the registered trade marks of Actors’ Trust and are Actors’ Trust’s Intellectual Property Rights. We are the owner of the Marks and/or licensee of all other Intellectual Property Rights appearing on or contained on this Site and on our social media feeds, unless otherwise indicated. You are not permitted to use our Marks or any other Intellectual Property Rights on our Site without our approval, other than as permitted under clause 9 (How you may use Content on our site).

 

8. Guidance on Content

8.1 The Content on our Site is provided for general information only, but it is not intended to amount to advice on which you should rely. 9.1.2 or the other provisions of these Website Conditions, you must not download any Content from our Site or save it to your computer.

 

10. Restrictions on your use of our Content

10.1 Unless we have given you our explicit written consent, you must not:

11. Our site is only for users in the UK

11.1 Our Site is directed to people residing in the United Kingdom. We do not represent that content available on or through our site is appropriate for use or available in other locations.

 

12. Third Party Content, ‘Partners’, and links to and from the Site

12.1 Where our Site contains links to other sites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them. We are not responsible for the content of third-party sites, or for Third Party Content. They are independent of Us, and we have no control over the contents of those sites or resources, even where the third party in question is stated to be a ‘partner’ of Actors’ Trust.
12.2 We have ‘partners’; persons (corporate or otherwise) with whom we have developed affinity products specifically to support the Actors’ Trust. If You agree to purchase goods or services offered on or through ‘partners’ or third-party sites, such as Christmas cards, the resulting agreement will be entirely between You and the ‘partner’ or relevant third party. We shall not be involved in, or have any responsibility under, those agreements.
12.3 We use iframes to connect with YouTube to display video across our Site. By using our Site, you agree to be bound by the YouTube Terms of Service.
12.4 You must not link to the Site for commercial purposes without our written agreement.
12.5 You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.
12.6 You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.
12.7 We reserve the right to withdraw linking permission without notice.
12.8 Other than as above, We encourage businesses and others to link their sites to the Site. However, if You wish to establish a link to the Site or any of its Content, we require that the link does not open within a frame-set of another website.

 

13. Acceptable use, no text or data mining, nor web scraping

13.1 You must not:
13.1.1 Use our Site in any way or take any action that causes, or may cause, damage to the Site or impairment of the performance, availability or accessibility of the Site;
13.1.2 Use our Site in any way that is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity;
13.1.3 Impersonate any person, or falsely or misleadingly state your affiliation with any other person;
13.1.4 Use our Site to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software;
13.1.5 Conduct, facilitate, authorise or permit any systematic or automated text or data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to our Site or any services provided via, or in relation to, our Site, for any purpose including the development of training, fine-tuning or validation of AI systems or models without our express consent;
13.1.6 Access or otherwise interact with our Site using any “robot”, “bot”, “spider”, “scraper” or other automated means, device, program, tool, algorithm, code, process or methodology to access, obtain, copy, monitor or republish any portion of the Site or any data, content, information or services accessed via the same; or any automated analytical technique aimed at analysing text and data in digital form to generate information or develop, train, fine-tune or validate AI systems or models which includes but is not limited to patterns, trends and correlations; or
13.1.7 Use data collected from our Site for any direct marketing activity (including without limitation email marketing, SMS marketing, telemarketing and direct mailing).
13.2 You must ensure that all the information you supply to us through our Site, or in relation to our Site, is true, accurate, current, complete and non-misleading.
13.3 The provisions in this clause should be treated as an express reservation of our rights in this regard, including for the purposes of Article 4(3) of the Digital Copyright Directive ((EU) 2019/790).

 

14. Viruses

14.1 We do not guarantee that our Site will be secure or free from bugs or viruses.
14.2 You are responsible for configuring your information technology, computer programmes and platform to access our site. You should use your own virus protection software.
14.3 You must not attempt to gain unauthorised access to our Site, the server on which our Site is stored or any server, computer or database connected to our Site or any other equipment or network connected with our site. You must not interfere with, damage or disrupt any software used in the provision of our Site or any equipment or network or software owned or used by any third party on which this Site relies in any way. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Site will cease immediately.

16. Our responsibility for loss or damage suffered by you

16.1 We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.
16.2 If you are a Business User:
16.2.1 We exclude all implied conditions, warranties, representations or other terms that may apply to our Site or any Content on it.
16.2.2 We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:
(a) use of, inability to use our Site, or results of use of our Site;
(b) use of or reliance on any Content displayed on our Site; or
(c) any websites linked to this Site or the material on such websites, including but not limited to loss or damage due to viruses that may infect your computer equipment, software, data or other property on account of your access to, use of, or browsing this Site or your downloading of any material from this Site or any websites linked to this Site.
16.2.3 In particular, we will not be liable for:
(a) Loss of income, profits, sales, business or revenue;
(b) Business interruption;
(c) Loss of anticipated savings;
(d) Loss of business opportunity, goodwill, data, contracts, or reputation; or
(e) any and all indirect or consequential loss or damages that result from your use of this Site.
16.2.4 If your use of Content on this Site results in the need for servicing, repair or correction of equipment, software or data, you assume all costs thereof.
16.3 If you are a Consumer User, we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

 

17. Becoming a member of the Actors’ Trust

17.1 If You register for an Actors’ Trust membership, You must also comply with our Membership Code of Conduct.
17.2 When signing up as a member, if you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.
17.3 We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these Website Conditions.
17.4 If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at hello@actorstrust.org.uk or call 0303 223 1110.

 

18. We may suspend or withdraw your access to our Site

18.1 Without prejudice to our other rights under these terms, if you breach these terms in any way, or if we reasonably suspect that you have breached these terms in any way, we may:
18.1.1 send you one or more formal warnings;
18.1.2 temporarily suspend your access to our Site;
18.1.3 permanently prohibit you from accessing our Site; or
18.1.4 commence legal action against you, whether for breach of contract or otherwise.
18.2 Where we suspend or prohibit or block your access to our Site or a part of our Site, you must not take any action to circumvent such suspension or prohibition or blocking (including without limitation creating and/or using a different account).

 

19. We may transfer this agreement to someone else

We may transfer our rights and obligations under these Website Conditions to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under these Website Conditions.

 

20. Law and Jurisdiction

20.1 If you are a Consumer, please note that these Website Conditions are governed by English law. We both agree that the courts of England and Wales will have exclusive jurisdiction except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.
20.2 If you are a Business User, these Website Conditions, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.
